General Terms and Conditions

I. Definitions

1. The IDEA SPONSOR platform - facilitates individuals, groups, social causes and non-profit organizations to raise funds online. The platform was developed and maintained by a non-profit organization IDEA SPONSOR which aims to:

• support all public initiatives aimed at implementing projects and activities aimed at asserting and promoting important public values ​​such as humanism, permanent learning and creativity, empathy and support to resolve the problems of other members of civil society and others;
• to pursue a policy of achieving the highest objectives of civil society - freedom, social justice, social progress, peace, security and tolerance;
• to promote and stimulate cultural interaction between different communities;
• to initiate and support public initiatives aimed at education, employment, youth career development, health, protection of human, civil, social and cultural rights, European integration, information technology, research, innovation, anti-discrimination, etc .;
• development, stimulation and support of professional and amateur sport, recreation and tourism, as well as support for the development of sports culture and values ​​in order to reach sport for young people and disadvantaged people;
• to support disadvantaged people;
• to support the development and stimulation of talented and prominent people in all spheres of art and science.

2. Non-profit association IDEA SPONSOR, Bulstat 176636048, registered in the Register of Non-Profit Legal Entities at the Pleven District Court № 44/2013, registered in the register of legal entities operating for public benefit at the Ministry of Justice under No 20140224003, with headquarters and address of management: Republic of Bulgaria, town of Knezha, pk 5835, Pleven District, 106 Rayko Daskalov Street, represented by Petar Petrov.

3. Customers - individuals and legal entities wishing to organize online donation campaigns to raise funds to support needy individuals through IDEA SPONSOR and / or to support the organization and conduct of a major public event. Campaign organizers can be adult and capable individuals as well as legal entities represented by their legal representatives or duly empowered persons.

4. Online campaign - enabling an individual who meets the requirements of the General Terms and Conditions for organizing and carrying out activities for announcing the respective donation campaign through IDEA SPONSOR, promoting it and raising money accordingly through IDEA SPONSOR to support the person and / or event concerned.

5. Donors - Individuals who provide personal funds for a particular online campaign in favor of the IDEA SPONSOR Non-Profit Organization to support deprived individuals through the IDEA SPONSOR platform and / or to support the organization and conduct of a major public event.

6. General Terms and Conditions - the current terms and conditions of the IDEA SPONSOR portal for launching and maintaining Online Donation Campaigns to raise funds to support needy individuals through IDEA SPONSOR and / or to support the organization and conduct of significant public event through the last, constitute a contract for the provision of a service for creation and maintenance of online campaigns of the Client, which service is provided by the non-profit organization IDEA SPONSOR to the Client. The general terms and conditions govern the rights and obligations of users, visitors and donors of the IDEA SPONSOR platform. The parties to the contract are the non-profit association IDEA SPONSOR and the client. The Customer declares that he is aware of these Terms and Conditions. Each action of the Customer on the IDEA SPONSOR platform is an electronic statement that he agrees with these Terms and Conditions.

II. Procedure for creating an online campaign

1. IDEA SPONSOR enables you to launch Online Donation Campaigns to raise funds to support needy individuals through IDEA SPONSOR and / or to help organize and conduct a major public event that a campaign is administered and maintained and stored by a non-profit organization IDEA SPONSOR.

3. When creating your online donation campaign, you must declare:

• that you will properly disclose the unique name of the campaign to all your users and donors;
• that you agree that 5% of the campaign account receipts be absorbed by the organization IDEA SPONSOR campaign administrator, for maintenance of the platform and paying bank fees for each individual campaign
• that you agree that the funds for the the campaigns will be collected by IDEA SPONSOR, a campaign administrator, in a bank account provided by a non-profit organization IDEA SPONSOR, and the amount raised, reduced by the amount of the agreed and negotiated administrative costs, will be provided to the client who uncovered the campaign and / or to a designated third party named by the latter within 7 (seven) business days after the closing of the campaign, at a bank account explicitly specified by the Client;
• that you agree that the evidence of the need for an online campaign to be provided to the competent state authorities during their inspections;
  that you agree that the evidence of the need for an online campaign to be provided to campaign donors upon request;
• that you are aware of the criminal responsibility for the untrue data declared by you. When creating your online donation campaign, you need to prove the need to run an online donation campaign by applying evidence - documents by making certified copies of them send within 3 (three) days to the following address Knezha (5835 ), 10 Rayko Daskalov Str., Pleven District, such as an epicrisis, expert's opinion, a certificate from a federation, a certificate from an institute, a school certificate, etc.

4. After clicking the "Create" button, it is considered that the Customer who created their online campaign accepts these Terms and Conditions.

5. After creating an online donation campaign, the customer receives an email confirmation.

6. In order to avoid the risk of incorrect or inaccurate data that may harm our clients, the online donation campaign you created is considered open after approval and sending an email confirmation to the Customer by IDEA SPONSOR.

7. The non-profit association IDEA SPONSOR is not responsible for incorrect or incorrectly filled in data.

III. Content of the online campaign

1. The customer should enter the name, campaign description, and the means required for recruitment, as well as attach images.

2. The customer is responsible for the truthfulness and legality of the information about the campaign. The Customer is also responsible for the data and information published by him, as well as any other texts, images and materials. The Client agrees that IDEA SPONSOR is not responsible for the information, texts, images and materials published by the Customer.

3. The Client is fully responsible for the copyright on the attached images, texts, and other information. The Client agrees that the Non-profit Association IDEA SPONSOR is not responsible for the acquisition and use of these rights.

4. The Customer agrees that the Non-profit Association IDEA SPONSOR is not the organizer of the campaign and is not responsible for the donations made by third parties.

5. The Customer undertakes not to publish texts, images and materials that violate the law, morality or rights of third parties.

6. The Customer agrees that the IDEA SPONSOR Non-profit Association is not responsible to donors, IDEA SPONSOR only provides a service for creating and maintaining an online donor campaign. The non-profit association IDEA SPONSOR is not responsible to the client when the latter has committed an offense or has damaged the rights or legitimate interests of third parties.

7. The Client agrees that in the event of a dispute with third parties or a sanction or other penalty of IDEA SPONSOR, in which case the Client undertakes to indemnify the non-profit association IDEA SPONSOR for all paid property sanctions, indemnities and other costs resulting from inaccurate or unlawful actions or omissions of the client, including where the customer has identified incorrect data, violated the rights of donors, third party copyrights, personal data, or competition rules and others.

IV. Donations

1. A non-profit organization IDEA SPONSOR enables the client to choose one of the ways in which donors will provide funds in the donation campaign.

2. The Client agrees that the Non-profit Association IDEA SPONSOR is not a payment institution, does not offer payment services and does not perform payment operations. These activities are performed by the relevant persons licensed to provide such services. The non-profit association IDEA SPONSOR provides the customer with a technical opportunity to integrate the described donation ways into the online campaign, but the Customer is responsible for providing payment services.

3. The Client agrees that the Non-profit Association IDEA SPONSOR is liable to the Customer solely and solely in connection with the provision of the amount credited to the campaign's donation account less the value of the agreed and negotiated administrative costs of the customer who disclosed the campaign and / indicated by the last assisted third party after the campaign is closed.

V. Online platform support

1. If a problem arises with access to or use of IdeaSponsor.org, the client will notify IDEA SPONSOR at: support.bg@ideasponsor.org

2. The non-profit organization IDEA SPONSOR will make all reasonable efforts to remedy the problem.

3. Non-profit association IDEA SPONSOR is not responsible for any problems caused by force majeure or other reasons other than a bug, as well as when the client or donors have entered incorrect or erroneous data or have used the online platform without complying these Terms and Conditions, the terms and conditions of the relevant online campaign, the instructions and instructions of the IDEA SPONSOR or the provisions of the law. Non-profit association IDEA SPONSOR is not responsible for damages and lost profits to the Customer due to a problem with the online platform.

VI. Personal data

1. Non-profit association IDEA SPONSOR is a personal data operator registered under the Personal Data Protection Act. The non-profit association IDEA SPONSOR undertakes to take care of the retention of personal data, as well as not to distribute, sell or provide to third parties the personal data of its clients unless it is necessary to carry out the activity of a non-profit organization IDEA SPONSOR or not required by a competent authority, as required by law.

2. By completing the personal data, the client confirms that he has provided his / her personal data voluntarily and that he / she expressly authorizes the collection, processing, storage and provision of such data in accordance with the Bulgarian legislation in force and when this is necessary for the provision of the offered services , for accounting purposes, to establish contact with the customer and to send notifications of services provided by the IDEA SPONSOR Non-profit Association.

3. When completing the data, the Customer is required to provide full and accurate data about his / her identity and other required data. If the customer has provided inaccurate or incomplete data, the IDEA SPONSOR Non-profit Association is not liable for non-performance commitments.

4. The Customer is responsible for the completion of any other personal data.

5. The Customer should register as a personal data operator in accordance with the Personal Data Protection Act and ask end-users for the collection, processing and storage of their personal data. The Customer is responsible for the way it collects, processes and stores the personal data to end users.

6. The non-profit association IDEA SPONSOR has the right to send unannounced pre-commercial communications to the Customer to inquire, conduct inquiries, or offer ads and other campaign information. Data can be used to send unsolicited commercial messages. With the completion of his or her data, the Client agrees with the non-profit organization IDEA SPONSOR to collect other data about the Client and the donors, such as IP address, visit time, site from which the website is accessible, version of the web browser, operating system, and other parameters provided by the web browser through which the website was accessed and any other information. The collected data can be used by IDEA SPONSOR for statistical and marketing research to improve the services provided to customers.

7. The Customer grants to IDEA SPONSOR the right to access, store and process the personal data of the end users, as well as any other information regarding the organized campaigns and the overall activity of the client. The non-profit association IDEA SPONSOR has the right to compare all these parameters and to publish at its own discretion any information and statistics about the client and its activities.

8. The Customer undertakes to provide the consent of the donors to collect this information through the Terms and Conditions of the respective online campaign.

VIII. Rights and obligations of the parties

1. The Customer understands and agrees that IDEA SPONSOR has the right to decide which actions of the Customer constitute a violation of these Terms and Conditions and to take appropriate measures to remedy the violation.

2. A non-profit organization IDEA SPONSOR is entitled to prohibit the use and launch of specific software, script, or other materials of the Customer when assessing the potential security risk and / or disrupting the normal operation of the platform.

3. The client is not allowed to add / configure any settings in the control panel, domains or subdomains, that are not entitled to use, control and manage.

4. The Customer undertakes not to publish virus-containing materials or other programs designed to destroy or damage the platform or other system, as well as materials with prohibited, defamatory, threatening or malicious content for IDEA SPONSOR or any third party. Non-profit association IDEA SPONSOR reserves the right to remove and / or edit similar material.

5. The non-profit organization IDEA SPONSOR reserves the right to terminate the provision of the Service to Customers whose online campaigns cause loads or other events that violate the normal operation of the platform, including if the Customer exceeded established limits.

6. The client agrees not to use the services provided by the non-profit organization IDEA SPONSOR to send unsolicited commercial communications (junk mail, spam) in violation of Bulgarian law and the rights of third parties.

7. The Customer may not use or allow third parties to use the platform to undertake and perform attacks and malicious actions on any other computer system connected to the Internet.

8. The Customer undertakes to make requests for system maintenance or other communication with the employees of the non-profit organization IDEA SPONSOR to observe the good practicess.

9. When the Customer grants access to use and manage his / her online campaign to third parties, he / she shall be responsible for the actions of these persons.

10. The Customer is responsible for the confidentiality of his or her access to the online platform (username and password) and assumes full responsibility for activities / actions performed through his account and in his online campaign. In case of doubt that for some reason the confidentiality of his or her data is under threat, the Client must immediately notify the team of the IDEA SPONSOR Non-profit Association.

11. A non-profit association IDEA SPONSOR is not required to monitor the information that it stores, transmits or makes available, nor to look for facts and circumstances indicating that an illegal activity has been committed.

12. The Customer understands and agrees that the Non-profit Association IDEA SPONSOR has the right to discontinue the Customer's access to the platform and the online campaign if the Customer violates the General Terms or the law, in which case IDEA SPONSOR is not responsible for loss of Customer data or other damages.

VIII. Termination of service

1. Violation of these Terms and Conditions may result in temporary or permanent termination of service and discontinuance of the Customer's access to the online campaign without any IDEA SPONSOR Non-profit Organization being owed notice, notice or any compensation to the Customer.

2. When the Customer uses the online platform of the respective campaign in violation of applicable law, present Terms of Service, or other rules, and when there is reasonable doubt about such action or omission, IDEA SPONSOR has the right to refuse to provide the service and to suspend the Customer's access to the platform without notice, notice and without indemnity or other compensation.

3. Under the above conditions, IDEA SPONSOR may, at its sole discretion, remove individual materials from the Customer's online campaign instead of completely discontinue its use by the customer.

4. At its own discretion, IDEA SPONSOR may, instead of terminating the service, require the Customer to remedy the breach, and Customer must take action to remedy the breach within 24 hours after receiving the notification if Non-profit association IDEA SPONSOR has not specified another deadline. Until the violation, IDEA SPONSOR has the right to temporarily suspend the provision of the Customer's services. When the Customer does not remedy the violation within the specified period, IDEA SPONSOR has the right to terminate the provision of the Customer's services in full. In any case, IDEA SPONSOR is not responsible for any loss of data on the part of the Customer and does not owe him any compensation.

5. In any case, the Customer owes indemnity to a non-profit organization IDEA SPONSOR for all damages and lost profits caused as a result of the breach.

IX. Complaints

1. The Customer has the right to complain if the services of the IDEA SPONSOR Not-for-Profit Association do not comply with these Terms and Conditions. The complaint may be submitted in electronic or written form and must contain customer details, including e-mail address, as well as a description of the breach.

2. The address for filing a complaint is in writing: Knezha (5835), 10 Rayko Daskalov Str., Pleven District

3. The complaint address in electronic form: support.bg@ideasponsor.org. The deadline for filing a complaint is 3 days from the event.

4. The IDEA SPONSOR Non-Profit Team will review complaints within 14 days of receipt and respond to the email address specified by the Customer.

X. Copyright and other intellectual property rights

1. All contents of the IDEA SPONSOR portal including all published texts, images, images, videos, articles, program code are copyrighted. They belong to the IDEA SPONSOR Non-profit Association and are under the protection of the Copyright and Related Rights Act. Copying and using them constitutes a gross violation of the author's rights and the imperative provisions of Bulgarian law.

2. Customer may not copy, store, process, publish, distribute in original or processed form, and otherwise use the texts, images or other parts of the content of the IDEA SPONSOR portal.

3. When creating an online campaign, the Customer does not acquire any rights or licenses on IDEA SPONSOR, the online campaign created by it or the brands of the IDEA SPONSOR Non-profit Association. Customer does not have the right to claim any rights or licenses on IDEA SPONSOR, the respective online campaign, their individual elements, or the trademarks of IDEA SPONSOR, no right to offer or grant such rights to third parties.

4. The client has no right to access the program code of the online campaign and may not copy or modify it in any way. Any attempt by the Client to access, copy or modify the platform program code is considered a gross violation of these Terms and Conditions and the rights of the non-profit organization IDEA SPONSOR. The Customer has no right to remove or hide any copyright or trademark information of the IDEA SPONSOR.

5. In case of non-performance, IDEA SPONSOR is entitled to immediately stop the use of the online platform for the respective campaign by the client without notice or notice and to claim damages for any damages and lost profits from the actions of the Client.

6. Prohibitions for the violation of copyright and other intellectual property rights of the IDEA SPONSOR Non-Profit Organization are valid for all third parties, and in case of violation IDEA SPONSOR is entitled to compensation for all damages and lost profits from the actions of the third parties.

Xl. Modifications to the IdeaSponsor.org platform

1. The non-profit organization IDEA SPONSOR has the right at any time to make changes and improvements to the platform as well as the form and content of the services provided as long as the essential functions of the online campaign are not violated.

2. The non-profit organization IDEA SPONSOR has the right to temporarily discontinue the offered services if it is necessary for their updating.

3. In these cases, IDEA SPONSOR is not responsible for damages and lost profits to Customers.

XII. Notifications

Unless explicitly stated otherwise, all notifications shall be made to the contact addresses advertised in a prominent place on the platform and, respectively, to the e-mail address and the contact address of the customer.

XIII. Visitor Information

All visitors are required to abide by these Terms and Conditions in their copyright and other rights section of IDEA SPONSOR, and to refrain from any action that would harm the rights or legitimate interests of the IDEA SPONSOR Nonprofit Association, including not to publish virus-containing materials or other programs designed to destroy or damage the platform or other system as well as materials with prohibited, defamatory, defamatory, threatening or malicious content for Non-profit association IDEA SPONSOR or third party. Non-profit association IDEA SPONSOR reserves the right to remove and / or edit similar material.

XIV. Amendment to the Terms of Service

1. Non-profit association IDEA SPONSOR reserves the right to change the terms and conditions without prior notice to customers.

2. A non-profit organization IDEA SPONSOR is not responsible for errors that may occur on the portal's website, including errors caused by changes, settings, and other actions not performed by the IDEA SPONSOR Not-for-Profit Association.

XV. Applicable law

For unsettled issues Bulgarian law applies, including when using the platform by foreign clients. All disputes relating to services provided through the IDEA SPONSOR are subject for resolving by the competent Bulgarian court.
